Right to repair is a concept that end users, business users as well as consumers, of technical, electronic or automotive devices should be allowed to freely repair these products. It means that the device should be constructed and designed in a manner that allows repairs to be made easily; the manufacturer should provide technical information (such as manuals and service handbooks) to consumers; the manufacturer should provide spare parts and tools for the maintenance, diagnosis, and repair of the device; and the consumer should have the choice to use the official repair shops or third-party service providers.

Right to repair has many benefits for consumers, society and the environment. Some of them are:

Challenges of Right to Repair

Right to repair also faces some challenges and opposition from various stakeholders. Some of them are:

  • Manufacturers may argue that right to repair compromises their intellectual property rights, quality standards, safety measures, and revenue streams.
  • Manufacturers may use various tactics to discourage or prevent consumers from repairing their products, such as using proprietary software, hardware or tools; voiding warranties if unauthorized repairs are made; limiting the availability of spare parts or information; or charging high prices for repairs or parts.
  • Consumers may lack the skills, knowledge or confidence to repair their products themselves or find reliable third-party service providers.
  • Consumers may face legal or technical barriers to access the information or parts they need to repair their products.

Latest Developments in India

India is one of the countries that is working towards implementing a right to repair framework. The Ministry of Consumer Affairs (MCA) has set up a committee to come up with a right to repair framework. The framework is significant as it will give consumers a chance to repair their products at an optimal cost instead of buying new products altogether. The important sectors for the initial focus of the framework are farming equipment, mobile phones & tablets, consumer durables, automobiles & automobile equipment. The MCA has also directed four other sectors – medical devices, solar energy equipment, IT hardware and software, and home appliances – to follow suit.

Under this framework, it would be mandatory for manufacturers to share their product details with customers so that they can either repair them by self or by third parties, rather than only depending on original manufacturers. The framework also aims to help harmonize the trade between the Original Equipment Manufacturers (OEMs), third-party buyers and sellers – thus also creating new jobs.

The MCA has also launched a portal called Right to Repair India, which has consolidated list of consumer care contact details of all major consumer products manufacturers for quick viewing. The portal also provides information on warranty and post-sales service information, links to the service network of the brands and third-party service providers, and prices of genuine spares and consumables of respective brands.

The right to repair movement is gaining momentum across the world as consumers demand more choice and control over their products. India is one of the countries that is taking steps to make this a reality for its citizens.
